Legal Disclaimer. These Terms of Service (“Terms”) govern use of the Adultra platform (“Adultra,” “we,” “us,” “our”).
1. Eligibility
- You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, whichever is higher.
- You confirm that accessing or producing explicit content is legal where you reside and where content is produced.
- Persons barred from receiving services under U.S. sanctions or other applicable regulations may not use Adultra.
2. Our Services
Adultra is a technology-driven, automated, Adult Talent Agency that enables registered Producers, Talent, and Crew to discover one another, negotiate scene parameters, collect payments as an Agent of the Payee, and release or refund funds. Adultra is not an employer, or guarantor of any user.
3. Identity Verification & 2257 Compliance
- All users must complete third-party KYC (currently Veriff). Legal names and documents are encrypted and stored in compliance vaults; they are never shared with other users.
- Producers must maintain age-verification records as required by 18 U.S.C.§ 2257 and affiliated regulations; Adultra is a “secondary producer,” limited to storing copies of records for audit purposes.
- Photos and videos undergo automated facial-recognition to confirm the uploader appears in the file and matches KYC records. Content failing verification is rejected and may be reported to authorities.
4. Wallets & Payments
- Agent-of-Payee. Talent and Crew appoint Adultra as agent to receive Producer payments on their behalf for bookings made through the platform. Payment to Adultra constitutes payment to Talent.
- When you sign up you receive a Web3Auth wallet on Polygon. All balances remain under your control; Adultra never takes custody of private keys.
- Commission. We charge an 8% commisssion on all bookings, paid by the Producer on top of booking price.
- Escrow Funding. Booking price + 8% agency commission must be paid to Adultra before a booking is considered confirmed.
6. Content Standards & Prohibited Use
- No minors, bestiality, non-consensual content, or any illegal sexual activity.
- Soliciting or facilitating prostitution or escort services is strictly prohibited. Adultra is for legal and documented adult film production only.
- Users are responsible for ensuring content legality in every territory where filming or distribution occurs.
7. Takedown Policy
Illegal or non-consensual content is removed immediately upon notice.
8. Termination
We may suspend or terminate accounts that violate these Terms or applicable law. Upon termination, any escrowed funds will be handled in accordance with smart-contract logic.
9. Disclaimers & Limitation of Liability
THE PLATFORM IS PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE PAST SIX MONTHS OR (B) ONE-HUNDRED U.S. DOLLARS (US $100).
10. Indemnification
You agree to indemnify and hold harmless Adultra, its officers, employees, and partners from any claim arising from your content or breach of these Terms.
11. Governing Law & Venue
These Terms are governed by the laws of the State of Tennessee, USA. Exclusive venue for any dispute shall be the state or federal courts located in Perry County, Tennessee.
12. Entire Agreement
These Terms, plus any referenced policies (Privacy Policy, 2257 Statement), constitute the entire agreement between you and Adultra.
